Distance Sales Agreement

This Distance Sales Agreement is entered into between the service provider listed below and the user who purchases services electronically via montherapy.me.
Article 1 – Parties

The natural or legal person who purchases services via the montherapy.me website or mobile application.
Article 2 – Subject of the Agreement
The subject of this agreement is to determine the rights and obligations of the parties regarding the provision of online therapy, psychological counselling, assessments, digital content, membership, expert consultations, appointments, or similar services purchased by the Buyer via montherapy.me.
Article 3 – Nature of the Service
montherapy.me is a platform where users can connect with experts, take assessments, schedule online sessions, receive expert matching, and obtain digital support. The type, scope, price, payment method, and any special conditions of the purchased service are as specified on the order/payment screen.
Article 4 – Formation of the Agreement
The Buyer acknowledges having read and understood the preliminary information on the site, and being informed about the essential characteristics, price, and method of fulfilment of the purchased service.
The agreement is formed electronically upon the Buyer's confirmation of the order and completion of payment.
Article 5 – Payment and Billing
The Buyer agrees to pay the service fee using one of the payment methods available on the site.
Payment transactions are processed through authorised payment infrastructure providers.
The service provider reserves the right to suspend or cancel an order in cases of suspicious transactions, security risks, system errors, or legal requirements.
Article 6 – Service Fulfilment
The purchased service is fulfilled digitally and in accordance with the nature of the service. Fulfilment may occur in the following ways:
- Expert matching
- Creating a session appointment
- Opening video/audio/text session access
- Granting access to an assessment
- Defining the service via the user panel
For appointment-based services, fulfilment is completed when the online session is conducted on the relevant date and time.
Article 7 – Buyer Obligations
- The Buyer acknowledges that the information provided to the system is accurate, current, and complete.
- The Buyer agrees to use the platform in accordance with the law and principles of good faith.
- The Buyer acknowledges that, due to the nature of the digital service, the right of withdrawal may be limited under applicable law once access to the service has been granted or fulfilment has begun.
Article 8 – Right of Withdrawal
The Buyer has legal rights of withdrawal under applicable consumer protection legislation.
However, the right of withdrawal may not apply in the following cases:
- Service agreements where performance has commenced
- Services specifically planned or matched for the user
- Digital content delivered instantly in an electronic environment
- Expert services where an appointment has been created and a preparation process has been initiated
- Other services exempt by applicable legislation
The Buyer acknowledges that where they consent to early commencement of the service, the right of withdrawal may be forfeited.
Article 9 – Cancellation and Return
Cancellation and return conditions are subject to the Delivery and Return Terms published on the site. The right of return may be limited based on the nature of the service for online therapy, assessments, digital access, expert matching, and appointment-based services.
Article 10 – Limitation of Liability
- The service provider does not guarantee definitive outcomes, definitive recovery, absolute satisfaction, or specific personal results beyond the scope of services offered on the platform.
- The service provider is not responsible for disruptions caused by the user's device, internet connection, software, microphone, camera, or personal access issues.
- The service provider's liability for temporary interruptions due to force majeure or technical infrastructure issues is limited to the extent permitted by applicable law.
Article 11 – Evidence Agreement
The parties agree that in the event of a dispute, the service provider's system records, electronic logs, payment records, email correspondence, and digital transaction records shall constitute evidence.
Article 12 – Dispute Resolution
Turkish law applies to disputes arising from this agreement. Authorised consumer arbitration committees and consumer courts have jurisdiction.
Article 13 – Entry into Force
By completing the payment process, the Buyer declares that they have read, understood, and accepted this agreement.
